Evidence is of little use in legal disputes if it was obtained illegally and is therefore inadmissible in court. Our detectives know exactly what they are permitted to do—and what they are not—to ensure the legal validity of the evidence.

What Are Investigators Not Allowed to Do?

Detectives who investigate individuals without a legitimate interest are committing an offence, as they are unlawfully infringing upon the person’s right to privacy. An exception applies if the investigators were deceived by the client and therefore believed a legitimate interest existed. In such a case, the client who acted fraudulently will have to answer to the court.


Moreover, any evidence obtained without legitimate interest will generally be inadmissible in legal proceedings. Image and audio recordings are also subject to personal rights. Audio recordings, in particular, are strictly prohibited under Art. 179ter of the Swiss Criminal Code, which protects the right to one’s own words. Similarly, Art. 179quater governs image recordings, though its interpretation is somewhat less restrictive. However, the highly personal intimate sphere is strictly protected—photographing or filming the subject in non-public indoor areas (such as bathrooms or bedrooms) is prohibited. Conversely, photographic evidence of investigatively relevant activities in public spaces is generally considered proportionate and therefore lawful.

 

In every case, the prerequisite for taking photographs is the legitimate interest of the person taking them—or of a third party on whose behalf they are taken (the client). The images may not be published in the media without the subject’s consent and may only be used for evidentiary purposes.
